A GER CANDIDATE THAT HAD A CHANGE OF HEART AFTER MILA

If a Ger candidate had a Mila, and before T'vela, decided against going through with the Geirus. If he ever changes his mind again and become a Ger, he wouldn't need Hatafas Dam Bris. Even though a circumcised Goy needs to have Hatafas Dam Bris in order to become a Ger (and here too he's coming to the second conversion already circumcised.) There, he wasn't circumcised in order to become a Ger. Therefore his circumcision is meaningless as far as Mila is concerned and needs a Hatafas Dam Bris. But here, where the original Mila was done to become a Jew, so the change of mind doesn't ruin the original Mila and they could precede by doing the T'vela.

AN EARLY MILA CONTINUED


 
The Minchas Chinuch says (from what he said in yesterdays's piece) that there is nothing intrinsically wrong with cutting off the Orlah earlier. It would just like burning Chametz before the time of the Mitzva of burning, which means there is no Mitzva to be done by the time the Mitzva comes around. The only Inyun would be what the Gemara says in Menachos about Davka getting a four cornered clothing to be able to Mikayim the Mitzva of Tzitzis. It protects the person when Hashem is angry. Therefore you cannot protest someone that does an early Mila.
 
We cannot say that the Torah, when saying to do the Mila on the eighth day, is in essence saying don't do it before hand, since we can't make up these Drashos by ourselves.

GIVING AN EARLY MILA


 
The Minchas Chinuch says that if someone gets a Mila before the eighth day, he's not an Oral anymore and doesn't have any obligation from the Torah to have a Mila. The obligation for a Hatafas Dam Bris would only be MiDarabanan. The Mitzva for a Mila is only on an Oral, but without the Orlah, there is no obligation at all. This would be compared to the Mitzva of Tzitzis. There is no obligation only if you have a four cornered clothing.
